This Cancellation Policy explains how consumers may exercise their statutory right to cancel eligible online purchases from SparkleMode.
14-Day Cooling-Off Period
For most goods purchased online, you have the right to cancel your purchase without giving a reason.
The cancellation period generally expires 14 days after the day you receive the goods.
Where a single order contains multiple goods delivered separately, the applicable period may run from receipt of the final item, as provided by law.
How to Cancel
To exercise your right to cancel, you must clearly inform SparkleMode of your decision before the cancellation period expires.
You may contact us using the contact information published on sparklemode.ie.
Your cancellation notice should preferably include:
- Your name
- Order number
- Contact details
- Product(s) being cancelled
- Date the order was received
You do not have to provide a reason for exercising a statutory cancellation right.
Returning Cancelled Goods
After notifying us that you are cancelling, you must normally return the goods within 14 days.
Unless SparkleMode agrees otherwise or applicable law requires SparkleMode to pay the cost, you are responsible for the direct cost of returning goods following a change-of-mind cancellation.
We recommend using a tracked return service and retaining proof of postage.
Condition of Returned Goods
You may inspect goods in a way that would reasonably be permitted in a physical shop.
You may be responsible for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Where possible, please return goods with their original packaging, tags and accessories.
Refund Following Cancellation
Where you validly exercise your statutory right to cancel, SparkleMode will refund payments due under applicable consumer law.
This normally includes the cost of the least expensive standard delivery method offered by SparkleMode for the original order.
If you selected a more expensive delivery option, such as express delivery, the additional delivery cost does not necessarily have to be refunded.
The refund will normally be made using the same payment method used for the original transaction unless another method is expressly agreed.
SparkleMode may be entitled to withhold the refund until:
- The returned goods have been received, or
- You provide evidence that the goods have been sent back,
whichever occurs first, where permitted by law.
Exceptions to the Right to Cancel
The statutory cooling-off right does not apply to certain categories of goods and services specified by law.
Relevant exceptions can include:
- Goods made to your specifications or clearly personalised
- Certain sealed goods that are not suitable for return for health-protection or hygiene reasons once they have been unsealed
- Other goods or services excluded by applicable consumer law
An exception to the change-of-mind cancellation right does not remove your legal rights if goods are faulty, damaged or not as described.
Cancelling Before Dispatch
If you wish to cancel an order before it has been dispatched, please contact SparkleMode as soon as possible.
Where cancellation is still operationally possible, we will attempt to stop the shipment and process the cancellation.
If the order has already been dispatched, the statutory returns procedure may need to be followed.
Faulty Goods Are Different
The statutory cooling-off period is separate from your rights regarding faulty or non-conforming products.
If an item is faulty, damaged or not as described, please contact SparkleMode. Your rights to an appropriate remedy are governed by applicable Irish consumer law and are not limited to the 14-day change-of-mind period.
